Khalid Ismael purchased a used Ford Tempo from Goodman Toyota dealership for his personal use, paying a total purchase price of $5,054.00 after trading in his vehicle valued at $1,600.00 and financing the balance for a total cost of $7,414.60. At the time of purchase, Ismael paid an additional $695.00 for a written service contract covering repairs for 24 months or 24,000 miles. The vehicle was sold “as is.” Immediately following the purchase, Ismael experienced considerable mechanical problems with the vehicle. He returned the car to the defendant for repairs on at least six occasions during the first six months of ownership, with defendant keeping the car for one to three weeks each time. Ismael was able to drive the car for only 700 total miles before being informed the vehicle was not repairable. By December 1989, less than a year after purchase, Ismael permanently stopped driving the car due to its unroadworthy condition, yet he continued making loan payments through the time of trial.
