The plaintiff and defendant were involved in a same-sex relationship during which they agreed to pool their resources for their mutual benefit. They purchased a house together, with the defendant contributing $5,000 and the plaintiff contributing $2,000 toward the $7,000 down payment. Although they initially intended to put both names on the title, the house was ultimately purchased in the defendant’s name alone, allegedly for tax purposes. The parties maintained joint checking and savings accounts, joint loans, and joint credit cards. They deposited their paychecks into their joint account and paid bills, including the mortgage, from this account. The plaintiff also made substantial improvements to the house. When their relationship ended in August 1978, the defendant initially moved out but returned in October 1978 after the plaintiff had vacated the premises. The plaintiff then sued for a half-interest in the house and an accounting for the defendant’s exclusive use of the property.
