The Port Authority of New York and New Jersey owns and operates three major airports in the New York City area: JFK, La Guardia, and Newark. These airports serve approximately 8% of the domestic airline market and more than 50% of the trans-Atlantic market. The terminals are generally accessible to the public and contain various commercial establishments. The Port Authority adopted a regulation prohibiting the solicitation and receipt of funds within the terminals if conducted in a continuous or repetitive manner. ISKCON, whose members perform sankirtan (a religious ritual involving the distribution of literature and solicitation of funds), challenged this regulation as a violation of their First Amendment rights. The Port Authority permitted these activities on the sidewalks outside the terminal buildings but not inside.
