International Products Company arranged with Erie Railroad to store goods arriving on the steamer Plutarch at Erie’s warehouse docks. On August 17, 1921, International Products inquired where the goods would be stored, specifically mentioning this was for insurance purposes. Erie responded that the goods were at “dock F, Weekawken,” though they had not yet been received from the steamer. In fact, the goods weren’t received until August 27th and 31st, and half were stored at dock D, not dock F. International Products obtained insurance based on this information. In November, dock D was destroyed by fire, and International Products could not collect on its insurance due to the misdescription of the storage location. The plaintiff sued to recover the insurance it would have been entitled to had the defendant provided accurate information.
