Fifty-five days before the terrorist attacks on September 11th destroyed the World Trade Center, World Trade Center Properties LLC (plaintiff) was granted a 99-year net lease on Towers One, Two, Four, Five. The agreement was valued at $2.805 billion and obligated the plaintiff to rebuild, restore, repair, and replace the towers. The plaintiff sued various aviation companies (defendants), alleging negligence and seeking to recover $16.2 billion for the replacement of the towers. The defendants filed a motion for summary judgment, arguing that the damages cannot exceed the market value of the property.
