In re Schoenkerman’s Estate
Citation:
294 N.W. 810Facts
In May 1928, Bern S. Schoenkerman’s wife died, leaving him with two children aged thirteen and seventeen. At his request, his mother-in-law Goldie Sucher and sister-in-law Ethel Sucher abandoned their home in Chicago to care for Schoenkerman’s home and children in Milwaukee. For approximately ten years, the mother-in-law performed cooking duties while the sister-in-law managed household purchases, clothing for the children, and all responsibilities typically handled by a wife and mother. On May 14, 1938, Schoenkerman executed promissory notes payable to the mother-in-law for $500 and to the sister-in-law for $1,500, due in eight months. After Schoenkerman’s death on May 18, 1939, the women filed claims against his estate for services rendered, applying the note amounts to their total claims of $500 and $4,610 respectively. The court allowed recovery only for the amounts stated in the notes.
