Richards (Respondent), an attorney in New Mexico, had a disciplinary hearing before the attorney disciplinary board, which recommended a public censure for knowingly making a false statement of material fact in a brief filed in the New Mexico Court of Appeals for the purpose of deceiving the appellate court. In the course of representing a client, Richards had filed a motion for a new hearing, and after the district court denied his motion, he appealed and made a false statement in that brief about the day on which he had made an objection to opposing counsel’s motion.
