Susann Bonds, a Swedish immigrant living in Canada, met Barry Bonds in Montreal in summer 1987 and moved to Phoenix to live with him in November 1987. Both were 23 years old and became engaged one week after she moved in. In January 1988, they decided to marry before spring training. Barry, earning approximately $106,000 annually as a professional baseball player, had discussed from the beginning of their relationship his desire to keep earnings and acquisitions separate, and Sun agreed, stating this was the Swedish practice. On February 5, 1988, approximately one to two weeks after an initial meeting with Barry’s attorneys, the parties met with attorneys Leonard Brown and Sabinus Megwa who explained the agreement paragraph by paragraph, informed Sun of her community property rights, advised her she could have independent counsel, and told her the agreement need not be signed that day. Sun, accompanied by her friend Margareta Forsberg, asked questions, requested changes to the agreement, and signed it after stating she understood its terms. They flew to Las Vegas that day and married the next day. Barry petitioned for dissolution in 1994, and Sun challenged the premarital agreement’s validity.
