In re Maher
Citation:
621 N.Y.S.2d 617 (1994)Facts
On December 11, 1992, attorney Francis E. Maher suffered a stroke, resulting in partial paralysis and aphasia. Following surgery, his condition left him unable to manage his business and finances. A conservatorship proceeding was initiated, appointing temporary receivers, but a conflict of interest led to changes in appointments. Maher’s condition improved by March 1993, and the conservatorship petition was withdrawn. However, his health and behavior later deteriorated, prompting renewed concerns. In May 1993, Maher revoked a power of attorney favoring his son and appointed a new representative. During this period, Maher expressed intent to marry Helen Kelly, a former colleague, against the backdrop of family tensions. He eventually married Kelly on June 17, 1993, after leaving his family home.
