In 1971, Elizabeth Greene consulted Guy Lanza about selling her home in Palisades Park, New Jersey. Lanza agreed to represent her. Later, without prior consultation with Greene, Lanza also agreed to represent the buyers, James and Joan Connolly. The parties signed a contract in Lanza’s office, though he played little role in negotiating its terms. When the closing date was rescheduled, Connolly informed Greene he would be short $1,000 and offered a post-dated check. Lanza advised Greene this was acceptable. After closing, when Greene tried to cash the check, it bounced. Connolly claimed there was a water problem in the basement that Greene had misrepresented. When Greene contacted Lanza for help, he took no effective action on her behalf, forcing her to retain new counsel and initiate legal proceedings against the Connollys.
