In re Grand Jury
Citation:
103 F.3d 1140Facts
The Court considered two cases. In the Virgin Islands case, a jury subpoenaed a former FBI agent whose 18-year-old son was the target of its investigation as a result of certain transactions in which he was allegedly involved. Seeking to quash the subpoena, the father testified that if he were coerced into testifying against his son, their relationship would dramatically change and the closeness they have would end. In the Delaware case, a sixteen year old minor daughter was subpoenaed to testify before the jury, as part of an investigation into her father’s participation in an alleged interstate kidnapping of a woman who had disappeared. A motion to quash made on behalf of the daughter and both her parents sought to bar the testimony of the daughter claiming a parent-child privilege.
