The decedent’s will left $50,000 to his grandchildren, to be placed in trust and administered until each grandchild turned 30. The income would accumulate until they reached that age, and they would receive their principal share along with interest at 30. At the time of death, there were six grandchildren, four born before the will and two after. After the final judgment assigned the $50,000 to the six by name, three more grandchildren were born before the eldest grandchild reached 30. Concerned whether the new grandchildren should be beneficiaries, the trustee sought clarification through legal proceedings regarding the final judgment and the interpretation of the will.
