In re Estate of Prince
Citation:
901 N.W.2d 234 (2017)Facts
John L. Nelson and Mattie Della Shaw were married from 1957 to 1968 and had children, including Prince Rogers Nelson. After John L. Nelson’s death in 2001, Prince died in 2016, and his sister Tyka filed for the appointment of a special administrator. Several others, including the Gresham appellants and Venita Jackson Leverette, claimed to be Prince’s half-siblings through different fathers. The district court authorized genetic testing and established a protocol for individuals to prove their parentage. Despite submitting affidavits and parentage information, the special administrator rejected their claims, stating that the presumption of paternity attached to John L. Nelson since Prince was born during his marriage to Mattie, and this presumption could not be rebutted.
