Defendant Clark owned a 24-unit apartment building Philadelphia. The five Plaintiffs were found to have endured “extensive discomfort and annoyance” as a result of the condition of their rental units. Defendant’s apartment building was fraught with issues such as crumbling walls, holes in the walls, broken and overflown toilets, mice infestation, lead paint, leaky ceilings, broken sinks, and warped and sloping floors. Most egregious among the problems was the fact that the tenants lived without any heat or water for two years and were forced to obtain heat by use of electric heaters and gas stoves. Reliance on these alternative heat sources presented additional dangers of fire and health detriments.
