Dr. Charles K.G. and Ms. Cindy C., an unmarried couple, began dating in 1994 and reunited in 1999 when they decided to have children together. Due to Cindy’s age (forty-five), they pursued in vitro fertilization through Nashville Fertility Center using anonymously donated eggs. On May 2, 2000, they executed a Recipient Consent agreement acknowledging Cindy would be the mother despite lacking genetic material. Charles paid $10,000 for the procedure. Two donated eggs were fertilized with Charles’s sperm; one divided, resulting in three embryos implanted in Cindy’s uterus. During Cindy’s complicated pregnancy, Charles resided with her and provided support. On February 21, 2001, Cindy gave birth via caesarian section to triplets. Birth certificates identified Charles as father and Cindy as mother. They initially shared parenting responsibilities and purchased a home together. When their relationship deteriorated and Charles allegedly became less involved and withheld financial support, Cindy filed a parentage action in April 2002 seeking custody and child support.
