Sandra Goodin purchased a new 2001 Hyundai Sonata from AutoChoice Hyundai dealership for $22,710.00 after test driving the vehicle and experiencing brake problems that the salesperson attributed to flat spots on tires. Hyundai provided three limited warranties including a five-year/60,000-mile bumper-to-bumper warranty. Despite multiple visits to authorized Hyundai dealers and repeated attempts to repair warped brake rotors through machining, the brake shimmy, vibration, and noise problems persisted throughout the warranty period. Goodin’s husband eventually replaced the rotors after the warranty expired, which reduced but did not eliminate the problem. An expert inspector concluded the vehicle was defective and unmerchantable at the time of manufacture. The jury found for Goodin on her implied warranty claim but the trial court initially set aside the verdict based on lack of vertical privity between Goodin and Hyundai.
