The plaintiffs were an elderly couple – the wife was an 82-year-old Klamath Indian and the husband was nearly 70 years old. The husband was an alcoholic who lived primarily on wine and suffered from mental and physical disabilities. The wife was physically disabled, walked with a cane due to a previously broken hip, and combined alcohol with Demerol, leading to severe impairment. Their living conditions had deteriorated to an almost indescribable state. Due to their condition, they were placed in a rest home, where the defendant, a real estate broker who had been on intimate terms with the plaintiffs for a considerable time, visited them and purchased their property. The defendant bought their home, furniture, and a 1967 Buick automobile for $7,000 in 1970, despite expert testimony establishing the actual value at $12,000. There was substantial evidence that the defendant was aware of the plaintiffs’ incompetent condition and knowingly took advantage of it.
