Hueper v. Goodrich

On August 15, 1974, a truck owned by Arland Gregor and operated by Emil Hueper collided with a truck owned by Dean Goodrich and operated by John M. Neubauer, causing severe injuries to Bruce Hueper, a minor passenger. Following a bifurcated trial, the jury found defendants Goodrich and Neubauer 85% liable. At the damages trial in 1980, the jury awarded Emil Hueper $37,270 for medical expenses, including $25,977 representing the reasonable value of care provided by Shriner’s Hospital, which provided all services free of charge and refused to accept any payment. The trial court applied the collateral source rule to allow full recovery and awarded prejudgment interest on the insurance policy amount from the liability determination date.
