Hotz v. Minyard
Citation:
304 S.C. 225, 403 S.E.2d 634Facts
Tommy and Judy Minyard, siblings, were involved in a dispute regarding their father’s two automobile dealerships, the Greenville and Anderson Dealerships. Tommy had managed the Greenville Dealership since 1977, and Judy worked at the Anderson Dealership, where she was designated successor dealer in 1985. Mr. Minyard executed two wills, one of which was shown to Judy by family lawyer Dobson. Judy was led to believe that she would inherit the Anderson Dealership and share equally in her father’s estate, based on the first will. However, after Judy confronted Tommy over his management of the Anderson Dealership, their father executed a codicil in 1986 removing Judy and her children from his will. Judy later agreed to a settlement with Tommy and Dobson, but she was eventually terminated from her position at the Greenville Dealership, leading her to seek legal recourse.
