Horne v. Harbour Portfolio

Harbour Portfolio VI, LP and Harbour Portfolio VII, LP (collectively “Harbour”) (defendant) purchased nearly all the properties from Fannie Mae’s real estate owned portfolio. These properties included homes that went through foreclosure but were ultimately not purchased by third parties. These properties were in poor or uninhabitable condition, but Harbour made no attempt to repair them before trying to sell them. Horne and a group of other homebuyers (collectively “the plaintiffs”) who were extended contract for deed home purchase extensions brought suit against the Harbour, alleging that they (Harbour) were engaging in reverse redlining. The plaintiffs argued that the companies’ marketing scheme intentionally targeted African-American buyers and that this scheme had a disparate impact on African-Americans.
