Hopper v. All Pet Animal Clinic, Inc.

Defendant worked for Plaintiff All Pet for three years. Her employment agreement stated that either she or her employer may terminate the agreement upon 30 days notice, and upon termination, Plaintiff agreed not to practice small animal medicine for a period of three years from the date of termination within 5 miles of the corporate limits of the City of Laramie, Wyoming. The president of Plaintiffs, Dr. R.B. Johnson, heard a rumor that Plaintiff was considering a purchase of a competing clinic and suggested that she buy out of the covenant not to compete. She declined and Defendant’s employment was terminated. Defendant subsequently opened her own veterinarian practice. Plaintiffs sued, seeking injunctive relief and damages. The trial commenced two years after Hopper had been discharged. The evidence at trial showed that over half of Defendant’s gross income was derived from her small animal practice and that Plaintiffs lost 187 of their clients to Defendant’s new practice. The evidence also showed that Plaintiffs’ clients were located throughout the county. The trial court granted an injunction, but declined to award damages to Plaintiffs as being too speculative. All of the parties appealed to the Supreme Court of Wyoming.
