The Plaintiff, twelve year-old Andrew Hojnowski, went to a store owned by the Defendant, Vans, in Moorestown, New Jersey. The store was a retail store that sold skateboards and related merchandise and had a recreational skateboard facility. To enter the skatepark, the Plaintiff’s mother was required to sign a release which included a provision that the required the arbitration of any claims of injury and a waiver of the right to seek damages if injured by the Defendant’s negligence. The Plaintiff’s mother signed the release stating that she understood its contents. While using the skate facility, an aggressive skater forced the Plaintiff off a skateboard ramp, causing him to fracture his femur. The Plaintiff’s parents had complained about this aggressive skater to the Defendant before.
