Hoddeson v. Koos Bros.
Citation:
135 A.2d 702 (1957)Facts
On August 22, 1956, Mrs. Hoddeson visited Koos Bros. furniture store in Rahway to purchase bedroom furniture she had previously seen. Upon entering, she was greeted by a man in a light gray suit who offered assistance. He guided her to the furniture she wanted, calculated the total price of $168.50, and accepted cash payment from her. He informed her the items would be delivered in September. When the furniture wasn’t delivered, Mrs. Hoddeson contacted the store only to discover they had no record of her purchase or payment. The store claimed the person who took her money was not their employee. Mrs. Hoddeson and her aunt, who accompanied her, could not positively identify the individual among the store’s regular salesmen, though they indicated one bore a resemblance. The store’s records showed this particular salesman was on vacation during the week of the incident.
