Plaintiff, Ms. Hoddeson, went to the defendants store to buy some bedroom furniture. The person who she met at the store asked her how they could help her. The man assisted the Plaintiff, added up the total for the items she requested and Plaintiff handed the man money for the items. The man in the store then informed Plaintiff that some of the requested items were not in stock but that they would be delivered to her. When the timeframe that the man gave passed, the Plaintiff contacted the defendant who informed her that there was no record of the sale nor did they recognize the salesman that sold it to her that day. Plaintiff brought suit and the District court found for the Plaintiff for reimbursement of her payment. Defendant appealed.
