The defendant, the Community is a private, nonprofit corporation that provides homes to people with AIDs and other terminal illnesses. In December 1992, the Community leased the residence located in a planned subdivision called the Four Hills Village, for use as a group home for four individuals with AIDs. The four individuals who moved into this home were unrelated, and each required some degree of in-home nursing care. The plaintiffs, Neighbors, live in the Four Hills Village neighborhood, and the area is subject to a restrictive covenant providing that no lot shall ever be used for any purpose other than single family residence purposes.
