Hassler v. Circle C Resources

Circle C Resources provides day and residential habilitation services to disabled clients in several Wyoming counties. In March 2015, Circle C hired Charlene Hassler, a CNA, to provide residential habilitation care in her home for one of its long-term adult clients. Upon hiring, Hassler signed a “Confidentiality and Noncompetition Agreement” that prohibited her from competing with Circle C for 24 months after employment in seven Wyoming counties and from providing services to any of Circle C’s clients. The agreement included a provision specifically allowing courts to modify any unreasonable terms. In January 2017, the client’s guardian became dissatisfied with Circle C’s services and decided to change providers. The client remained in Hassler’s home for residential care but transferred to another provider for day rehabilitation. Hassler continued to care for the client but was paid by the new provider. Circle C demanded Hassler cease providing services to the client, claiming she violated the noncompete agreement. Although Hassler temporarily stopped providing paid services, the client continued living in her home while Hassler’s family members provided care.
