Two petitions were consolidated to include complaints from 19 different states and many private Plaintiffs alleging that the Defendants, members of the insurance industry, conspired in violation of the Sherman Act to restrict the terms of coverage of commercial general liability (“CGL”) insurance available in the U.S. Plaintiffs’ complaints alleged that the Defendants conspired to force certain primary insurers to change the terms of their standard CGL insurance policies to conform with the policies the Defendants wanted to sell. The District Court dismissed the claims that named only certain London-based Defendants. The Court of Appeals reversed. The U.S. Supreme Court granted certiorari to No. 91-1111 and No. 91-1128. Casebook omits the discussion concerning No. 91-1111.
