Seven-year-old Katheleen has a potentially life threatening kidney condition. Doctors have advised that a kidney transplant, if the kidney were donated by the child’s identical twin, presents “substantially a 100 percent chance” that the twins would live out a normal life span. The risks if one of the parents donated a kidney would be much higher and the chances of survival would be much lower. Everyone involved (the twins and the parents) have therefore consented to the kidney transplant between the twins. However, the physicians have refused to perform the transplant unless the court finds that the parents are allowed to consent to the operation.
