An American Airlines aircraft crashed in Kentucky, killing 58 out of the 62 people on board. Multiple wrongful death actions against American Airlines (Defendant) were instituted in New York and elsewhere. The first case to be tried to conclusion was brought in Texas district court, and the jury decided the case for the plaintiff and determined that American Airlines was liable. The issue of liability in the Texas case was identical to the issue of liability in the present case, so Hart (Plaintiff) moved for summary judgment on the basis of collateral estoppel.
