Supreme Court of Northern Carolina 225 N.C. 690, 36 S.E.2d 227 (1945)Facts
Defendant assaulted his wife, who took refuge in the plaintiff’s house. The next day, the defendant went into plaintiff’s home and assaulted his wife again. The defendant’s wife knocked the plaintiff down with an axe and the plaintiff caught an axe that was aimed at the defendant. This saved the defendant’s life, but badly injured the plaintiff. Defendant then orally promised to pay the plaintiff her damages, but did not pay more than a small sum. The plaintiff sued for the remainder of the promised payment.
