Hansen v. Heath

Woo blacked out while driving and rear-ended Hansen’s vehicle. During the ambulance ride, Woo told the treating physician he had lost consciousness and could not remember anything preceding the accident. It was determined Woo had suffered a syncopal episode, for which he would later receive treatment.
Hansen sued Woo for negligence. Prior to the lawsuit’s conclusion, Woo died. Heath, as the representative of Woo’s estate, sought to admit evidence of Woo’s statements made to the treating physician.
