The Committee for Industrial Organization and individual citizens sought to hold public meetings and distribute literature in Jersey City to inform workers about the National Labor Relations Act and organize labor unions. Jersey City officials, led by Mayor Hague, adopted and enforced policies excluding labor organizers from the city, preventing distribution of pamphlets and leaflets, and denying permits for public meetings. Officials used police force to physically remove organizers, conduct warrantless searches and seizures, make arrests, and transport individuals beyond city limits or onto ferries to New York. The materials sought to be distributed were lawful, non-offensive, and related to workers’ rights under federal law. Respondents repeatedly applied for permits as required by ordinance but were consistently denied. The city ordinance gave the Director of Public Safety discretion to refuse permits to prevent “riots, disturbances or disorderly assemblage” without objective standards.
