Defendant brought materials for printing the magazine to Plaintiff’s office and discussed problems concerning the layout with Plaintiff’s agent. The agent told Defendant that the job could be done “in house” and that the price would remain the same over the next six issues of the magazine. Later, the agent told Defendant that the cost would increase because Plaintiff had to “send the stripping out.” Plaintiff delivered the first 5,000 magazines to Defendant. Defendant signed the purchase order reflecting the new price and paid Plaintiff $4,650 on account of the purchase. Plaintiff then sent the complete shipment of 15,000 magazines. Defendant then informed Plaintiff he would not accept the price increase.
