Duke Power Company operated the Dan River Steam Station with five departments, historically restricting African American employees to the lowest-paying Labor Department. Prior to July 2, 1965, the company openly discriminated based on race. In 1955, the company required a high school diploma for assignment to departments other than Labor. On the effective date of Title VII, the company added requirements for satisfactory scores on the Wonderlic Personnel Test and Bennett Mechanical Comprehension Test. These requirements disqualified African Americans at substantially higher rates than white applicants. White employees hired before these requirements were instituted continued to perform satisfactorily without meeting them. The company made no showing that the diploma or test requirements were significantly related to successful job performance.
