Gresser v. Hotzler
Citation:Court of Appeals of Minnesota 604 N.W.2d 379 (2000)
Plaintiff, a real estate investor, began negotiating with Defendant to purchase a real estate property. In July, Gresser sent one draft of an unsigned purchase agreement. On August 4th, the Hotzlers changes terms, initialed the changes, signed the agreement, and returned it to Gresser’s Attorney. On August 10th, Gresser initialed the changes and signed it, then made two additional changes to the survey delivery date and the closing date. These changes were made on the advice of his attorney, who had spoken to the Hotzlers’ realtor, but the realtor had not consulted Hotzler. After that date, Hotzler received another offer and signed that purchase agreement.
