Elizabeth Greisz purchased a dual furnace-air conditioner from Golden Seal Heating & Air Conditioning and charged the purchase on a credit card issued by Household Bank. When she received her first monthly credit card statement reflecting the purchase, it listed the price as $5,080, but she believed it should only be $4,010. Greisz refused to pay any part of the bill and instead filed suit against both Household Bank and Golden Seal, alleging violations of the Truth in Lending Act and supplemental state law claims under Illinois consumer protection statutes. Her attorney, Joseph A. Longo, sought to have the case certified as a class action. The district court denied class certification and granted summary judgment for defendants on all counts except a small portion of one Truth in Lending claim against Household Bank. After Household Bank made a Rule 68 offer of judgment of $1,200 plus reasonable costs and attorney’s fees, which exceeded the maximum statutory damages of $1,000 available under the Truth in Lending Act, Greisz rejected the offer at her attorney’s urging, and the district court subsequently dismissed the remaining claim.
