Since 1999, the Town of Greece, New York, began its monthly town board meetings with a prayer delivered by a local clergyperson. The town selected clergy by calling religious organizations listed in a local directory until someone agreed to serve as “chaplain of the month.” Because nearly all congregations in town were Christian, from 1999 to 2007, all participating ministers were Christian and many prayers contained distinctly Christian references. After residents Susan Galloway and Linda Stephens complained, the town invited a Jewish layman, a Baha’i chairman, and a Wiccan priestess to deliver prayers in 2008, but subsequently returned to inviting primarily Christian clergy. The town meetings included both legislative and adjudicative functions, with citizens attending to speak on local issues, request permits, or receive awards. The plaintiffs did not seek to end the prayer practice but requested an injunction limiting the town to “inclusive and ecumenical” prayers that referred only to a “generic God” and would not associate the government with any one faith.
