Greco v. United States

Sundi Greco received medical treatment for her pregnancy at Nellis Air Force Base in Nevada. While Greco was receiving treatment, physicians allegedly became aware of her unborn son Joshua’s permanent disability and neglected to inform Greco of their findings. When Joshua was born with permanent disabilities, she sued the United States in the United States District Court for the District of Maryland on behalf of both herself and her son, making medical malpractice claims and “wrongful life” claims on behalf of her son. In the “wrongful life” claim, Greco alleged that her son was forced to suffer a life of pain because of the negligence of the attending physicians.
The United States moved to dismiss the claim on the grounds that Greco had failed to state a claim. The district court filed a certification order to the State of Nevada on the issue, asking for clarification on the medical malpractice claim and the “wrongful life” claim.
