Bill Graham (plaintiff) entered into a contract with Scissor-Tail, Inc. (defendant), a corporation that represented recording artist Leon Russell. Graham signed four contracts with Scissor-Tail. The contracts were all prepared on identical forms generally used in the industry by members of the American Federation of Musicians (“AFM”). The contracts specified that any dispute with Scissor-Tail would be subject to arbitration. After Graham and Scissor-Tail’s efforts to launch a multi-city concert tour for Russell failed, the parties disputed over how to recoup the lost profits. Unable to resolve the issue, Graham sued Scissor-Tail for breach of contract. Scissor-Tail moved to compel arbitration.
