R.S. Gorton brought suit as Guardian ad liten on behalf of his son Richard (Plaintiff) after his son was injured in an automobile accident while headed towards a sports game. At the time of the accident Russell Garst (Defendant’s Agent), the head coach was driving the car. The car was owned by Miss. Doty (Defendant). According to testimony, Doty loaned Garst the car. Doty however, did not direct the Garst’s work, Garst was not paid, but Doty conditioned the use of her car on Garst being the one to drive. Plaintiff brought suit at the trail court and the jury returned a judgement in their favor. Defendants moved for a new trial it was denied by the trial court. Defendant appealed.
