Two thirteen-year-old boys, both residents of North Carolina, were killed in a bus accident in Paris, France. The accident was attributed to a defective tire manufactured in Turkey at the plant of a foreign subsidiary of The Goodyear Dunlop Tires Operations, S.A. (“Goodyear”). The parents of the two boys brought suit in North Carolina state court against Defendant, Goodyear, and three of its foreign subsidiaries for damages. Goodyear is an Ohio corporation, and the three foreign subsidiaries were organized and operating in Turkey, France, and Luxembourg, respectively. Since Goodyear had plants in North Carolina and engaged in commercial activity there, it did not contest personal jurisdiction. Goodyear’s subsidiaries moved to dismiss for lack of personal jurisdiction and the trial court denied. The North Carolina Court of appeals affirmed the trial court’s decision, and the U.S. Supreme Court granted Defendants’ petition for certiorari.
