J.B. visited Goldstein, Garber & Salama (GGS) for a dental procedure requiring sedation. Paul Serdula, a certified registered nurse anesthetist working as an independent contractor, administered the sedation. While J.B. was sedated, Serdula sexually assaulted her and recorded the assault. The assault was later discovered when Serdula’s hidden camera was found at another medical office, leading to a police investigation that uncovered multiple recordings of assaults, including J.B.’s. J.B. sued GGS, claiming they were negligent in failing to properly monitor her while under sedation and for failing to perform an adequate background check on Serdula. At trial, evidence showed that GGS did not have specific protocols for monitoring sedated patients, and that Serdula had been left alone with J.B. during the procedure.
