The plaintiff, Genovese leased a space of land owned by Copaco and Bercrose for use as a pharmacy. In negotiating the lease Genovese obtained Bercrose’s agreement to a restrictive covenant preventing Bercrose and Copaco from leasing space to any drive-thru film development businesses. The lease was between Bercrose and Genovese, but Copaco, via its president, also agreed in a separate document attached to the lease. Pursuant to Conn. Gen. Stat. § 47-19 (1977). A memorandum of lease was recorded indicating where the full lease was. Later, Copaco negotiated a lease with FotoMat to operate a film development kiosk in the parking lot. Genovese sued.
