Constitutional Law Keyed to Choper
Geduldig v. Aiello
Citation:
417 U.S. 484 (1974)Facts
California’s disability insurance program was established in 1946 to provide benefits to employees temporarily unable to work due to disability not covered by workers’ compensation. The program was funded entirely through mandatory employee contributions of 1% of wages (up to $85 annually). Benefits ranged from $25 to $105 weekly, beginning on the eighth day of disability or the first day of hospitalization, for up to 26 weeks. The program covered most physical and mental disabilities but excluded disabilities resulting from pregnancy. After a California Court of Appeal decision (Rentzer v. Unemployment Insurance Appeals Board), the state began covering disabilities from abnormal pregnancy complications but continued to exclude disabilities from normal pregnancy and childbirth. Three of the four plaintiffs (Aiello, Armendariz, and Johnson) had abnormal pregnancy complications and subsequently received benefits under the revised interpretation, but Jaramillo, who had a normal pregnancy, remained excluded from coverage.
