On April 9, 2001, Courtney Garza, a 21-year-old college student, hanged herself in her parents’ home. Her parents and brother brought a wrongful-death action against a national fraternity, the university, and other defendants, alleging that Courtney had been raped by a fraternity member as a result of defendants’ negligence in failing to supervise activities at the fraternity, and that defendants also failed to provide adequate crisis intervention after the rape. Courtney left a handwritten suicide not, expressing inability to cope with trauma caused by the rape. The trial court admitted the note of the decedent as a dying declaration.
