Citation:
732 N.E.2d 1262 (Ind. App. 2000).Facts
On June 2, 1994, Isaac was issued car insurance for her 1986 Pontiac Fiero through Gallant’s agent, Thompson-Harris. The term of the policy was from June 2, 1994-December 2, 1994. On December 2, Isaac traded in her Fiero for a 1988 Pontiac Grand Prix. Per the terms of her financing, Isaac’s needed to obtain “full coverage” insurance on the Grand Prix. Isaac contacted Thompson-Harris to renew and enhance her existing coverage. Thompson-Harris informed Isaac they would immediately “bind” coverage on the Grand Prix and she could come in on Monday, December 5 (after the weekend) to finalize the paperwork and pay the premium. On December 4, Isaac was involved in a motor vehicle accident. The following day, Isaac reported the accident to Thompson-Harris and paid the premium. On December 22, Gallant renewed Isaac’s insurance with an effective period of December 6, 1994-June 6, 1995.
