Gall was a student who was indicted in the Southern District of Iowa on drug conspiracy charges. He entered into a plea agreement with the Government, which recommended a sentencing range of 30 to 37 months of imprisonment. The record of his sentencing hearing included a “small flood” of letters from his parents and other relatives and acquaintances praising his character and work ethic. The prosecution requested that the court nonetheless impose a prison sentence within the Guidelines range. The judge sentenced him to probation for a term of six months. The Court of Appeals reversed and remanded for resentencing.
