Fuller v. Preis
Citation:
35 N.Y.2d 425 (1974)Facts
A man named Lewis committed suicide seven months after an automobile accident with Preis (Defendant), in which Lewis suffered a brain injury that caused vomiting, seizures, and hospitalization. Before the suicide, Lewis acquired a gun, changed his will, and wrote notes to his family members. Lewis’s estate, represented by Fuller (Plaintiff), sued Preis for causing the automobile accident and ultimately the suicide on a theory of negligence, arguing that Lewis’s injuries resulting from the accident were the proximate cause of his suicide.
