Freedman (plaintiff) entered into an agreement to purchase two lots of land from Rector, Wardens, and Vestrymen of St. Mathias Parish (defendants). But the plaintiff repudiated the contract on November 28th and demanded his deposit back when he found out that the Water and Power Department had an easement across the rear five feet of the property. Later, the plaintiff told the defendants he would complete the purchase if the easement was removed. Instead, the defendants entered into a new agreement with a different purchaser. In January, the plaintiff sued the defendants, seeking specific performance of the sale.
