Franklin v. Anna National Bank
Citation:
140 Ill. App. 3d 533, 94 Ill. Dec. 870, 488 N.E.2d 1117Facts
Frank Whitehead, who died on December 22, 1980, added his late wife Muriel’s sister, Mrs. Goddard, as a joint tenant on his savings account in April 1978, granting her survivorship rights. Mrs. Goddard testified she neither deposited nor withdrew funds but signed the account card to assist with finances. In January 1979, Frank attempted to replace Mrs. Goddard with Enola Stevens as joint tenant through handwritten letters delivered to the bank. However, the bank retained the original account card signed by Frank and Mrs. Goddard, as account changes required proper procedures, which were not followed.
